Collection of personal information
Personal information is data that can be used to identify or contact a single person. When you create a Franklin Armory® account, purchase a product, contact us by any electronic means including e-mail, website submissions, social media or participate in an online survey, we may collect a variety of information, including; your name, job title, contact information, and demographics. Contact information may include your mailing address, phone number, email address, and contact preferences. Demographic information may include your date of birth, postcode, interests, device identifiers, IP address, location information, and credit card information.
You may be asked to provide your personal information anytime you are in contact with Franklin Armory® or a Franklin Armory® affiliated company. Although you are not required to provide the personal information that Franklin Armory® may request, choosing to not supply the requested information may result in the delay or inability to provide you with our products and services or respond to any inquiries you may have.
Use of personal information
We may use your personal information, including date of birth, to verify identity and to determine appropriate services. For example, we may use date of birth to determine the age of Franklin Armory® account holders.
We also use personal information to help us create, develop, operate, deliver, and improve our products, services, content and advertising, as well as for loss prevention and anti-fraud purposes. Where we use your information for anti-fraud purposes arises from the conduct of an online transaction with us. We limit our uses of data for anti-fraud purposes to those which are strictly necessary and within our assessed legitimate interests to protect our customers and our services. For certain online transactions we may also validate the information provided by you with publicly accessible sources.
For marketing purposes, the personal information we collect allows us to keep you posted on Franklin Armory® product announcements and upcoming events. If you don’t want to be on our mailing list, you can opt-out anytime by updating your preferences or clicking “unsubscribe” on the email.
From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies.Due to the sensitive nature of some information that is important to your interaction with Franklin Armory®, you may not opt-out of receiving these communications.
We may also use personal information for internal purposes such as auditing, data analysis, and research to improve Franklin Armory® products, services, and customer communications.
If you enter into a sweepstake, contest, or similar promotion we may use the information you provide to administer those programs.
If you apply for a position at Franklin Armory® or we receive your information in connection with a potential position with Franklin Armory®, we may use your information to evaluate your candidacy and to contact you. If you are a candidate, you will receive more information about how Franklin Armory® handles candidate personal information at the time of application.
Alternate sources for personal information data acquisition
We may have received your personal information from other persons if that person has shared content with you using the Franklin Armory® website or via social media, sent gift certificates and products, or invited you to participate in Franklin Armory® services, social media or forums.
If you are a potential candidate for employment with Franklin Armory® we may have received your personal information from third parties such as recruiters or external websites. We will use the personal information we receive to contact you about a potential opportunity or in evaluating your candidacy. If you did not provide us your personal information directly, we will inform you of the source when we first contact you regarding your candidacy.
For research and development purposes, we may use datasets such as those that contain images, voices or other data that could be associated with an identifiable person. When acquiring such datasets, we do so in accordance with applicable law in the jurisdiction in which the dataset is hosted. When using such datasets for research and development, we do not attempt to re-identify individuals who may appear therein.
Collection and use of non-personal information
We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:
We may collect information such as occupation, language, zip code, area code, unique device identifier, referrer URL, location, and the time zone so that we can better understand customer behavior and improve our products, services, and advertising.
We may collect and store details of how you use our services, including search queries. This information may be used to improve the relevancy of results provided by our services. Except in limited instances to ensure quality of our services over the Internet, such information will not be associated with your IP address.
With your explicit consent, we may collect data about how you use your device and applications in order to help app developers improve their apps.
Do not track
Franklin Armory® does not track its customers over time and across third-party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. Third parties that have content embedded on the Franklin Armory® website and social media platforms may set cookies on a user’s browser or app and/or obtain information about the fact that a web browser visited the Franklin Armory® website from a certain IP address. Third parties cannot collect any other personally identifiable information from the Franklin Armory® website unless you provide it to them directly.
Cookies and other technologies
If you want to disable cookies, you may do so within your browser settings. Contact the manufacturer of your browser for more information on how to disable cookies with your particular browser and version. Please note that certain features of the Franklin Armory® website will not be available once cookies are disabled.
In some of our email messages, we use a “click-through URL” linked to content on the Franklin Armory® website. When customers click one of these URLs, they pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages. Pixel tags enable us to send email messages in a format that customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.
Franklin Armory® and our partners and licensees, may collect, use, and share precise location data, including the real-time geographic location of your computer or device. Where available, location-based services may use GPS, Bluetooth, and your IP Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, and other technologies to determine your devices’ approximate location and share that information with Franklin Armory®. Unless you provide consent, this location data is collected anonymously in a form that does not personally identify you and is used by Franklin Armory® to provide and improve location-based products and services. For example, your device may share its geographic location with application providers when you opt into their location services.
The existence of automated decision-making, including profiling
Franklin Armory® does not make any decisions involving the use of algorithms or profiling that significantly affect you.
Disclosure to Third Parties
At times, Franklin Armory® may disclose certain personal information to third parties to provide or improve our products and services, or to help Franklin Armory® market to consumers. As an overall function of our business, Franklin Armory® shares personal information with companies who provide services such as information processing, extending credit, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in our products and services, and conducting customer research or satisfaction surveys. When we do, we require those third parties to handle it in accordance with relevant laws. Franklin Armory® does not sell personal information and personal information will never be shared with third parties for their marketing purposes.
The Franklin Armory® website and social media platforms may contain links to third-party websites, products, and services. Our products and services may also use or offer products or services from third parties − for example, a third‑party accessory manufacturer.
Information collected by third parties, which may include such things as location data or contact details, is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.
It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for Franklin Armory® to disclose your personal information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you, but only where there is a lawful basis for doing so, if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users. Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal information we collect to the relevant third party.
Integrity and Retention of Personal Information
Your privacy rights
You can help ensure that your contact information and preferences are accurate, complete, and up to date by signing into your Franklin Armory® account page. For other personal information we hold, we will provide you with access (including a copy) for any purpose including to request that we correct the data if it is inaccurate or delete the data if Franklin Armory® is not required to retain it by law or for legitimate business purposes.
When you make a request we will verify your identity and the legitimacy of your request. We may decline to process requests that are frivolous, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. We may also decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes.
Franklin Armory® also complies with the advanced Consumer Privacy Act’s of California, Colorado and Virginia. Please refer to the privacy laws relevant to your jurisdiction for further information.
Notice to minors
Franklin Armory® is a firearms manufacturer and it is our policy to restrict minors and those who are not of age to purchase or acquire firearms from the use of our website or social media platforms.
We understand the importance of taking extra precautions to protect the privacy and safety of children using Franklin Armory® products and services. Persons under the age of 18, or equivalent minimum age in the relevant jurisdiction, are not permitted to create their own Franklin Armory® accounts. If we learn that we have collected the personal information of a child under 18, or equivalent minimum age depending on jurisdiction, we will take steps to delete the information as soon as possible.
The Franklin Armory® privacy promise and what you can do to protect yourself
Franklin Armory® takes the security of your personal information very seriously. When utilizing the Franklin Armory® website, we protect your personal information during transit using encryption such as Transport Layer Security (TLS). When your personal data is stored by Franklin Armory®, we use computer systems with limited access which are housed in facilities using physical security measures.
When you post on a Franklin Armory® forum, chat room, or social networking service, the personal information and content you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to share or submit in these instances. For example, if you list your name and email address in a forum posting, that information is public. We advise utilizing precaution when posting your personal information socially.
Privacy Rights of California Residents
The California Consumer Privacy Act (CCPA) provides California residents with specific rights regarding their personal information. This section describes the rights of California residents under the CCPA and explains how to exercise those rights. These rights are only available to current residents of the State of California.
Franklin Armory® gathers information from the following categories of Personal Information identified by the CCPA:
- Customer Records Information
- Commercial Information
- Access to Specific Information and Data Portability Rights
You have the right to request that Franklin Armory® disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:
- The categories of personal information we collected about you,
- The categories of sources for the personal information we collected about you,
- Our business or commercial purpose for collecting or selling that personal information,
- The categories of third parties with whom we share that personal information,
- The specific pieces of personal information we collected about you (also called a data portability request),
- If we disclosed your personal information for a business purpose, we will disclose the personal information categories that the recipient obtained.
Deletion Request Rights
You have the right to request that Franklin Armory® delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation; or
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Access, Data Portability, and Deletion Rights
To exercise the rights described above, please submit a verifiable consumer request to us by either calling us at 775-783-4313 or by submitting a digital request through email at firstname.lastname@example.org.
Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
Making a verifiable consumer request does not require you to create an account with us.
We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Response Timing and Format
We will confirm receipt of a verifiable request within 10 days and provide information about how the request will be processed. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will respond to a verifiable request in the same format in which the original request was made.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not do any of the following based upon your decision to exercise your rights under the CCPA:
- Deny you goods or services;
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
- Provide you a different level or quality of goods or services; or
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
Franklin Armory® complies with all applicable state and federal laws and reserves the right to deny or modify any goods, services, or prices in compliance with state and federal law.
